1. About these terms
These terms apply when you browse, request a quotation from, or place an order with Design Stitch Sew Ltd, trading as Design Stitch Workwear (we, us or our). They should be read with our Privacy Notice and Returns Policy. If you are buying for a business, you confirm that you have authority to bind that business.
2. Products, artwork and quotations
Many of our goods are personalised, embroidered, printed or otherwise made to your specification. Product images, garment colours and decoration previews are illustrative; reasonable variations may occur between screens, production methods and batches.
You are responsible for checking that all sizes, quantities, spellings, artwork, logos, colours and placement details are correct before approving an order or proof. You confirm that you have the rights or permissions needed for any artwork, logo, wording or other material you provide. We may decline material that we reasonably believe is unlawful, infringing, offensive or unsuitable.
Quotations are invitations to order, not binding offers, unless we state otherwise in writing. We may correct genuine pricing or description errors before accepting an order.
3. Orders and contract formation
Submitting an order, accepting a quotation or making payment is an offer to buy. A contract is formed only when we confirm acceptance by email, issue an order confirmation, or begin production, whichever happens first. Please check the confirmation and contact us promptly if anything is wrong.
4. Price, payment and VAT
Prices, delivery charges and VAT (where applicable) are shown or confirmed before you place your order. Payment may be made by the methods offered at checkout or agreed with us, including card payment through Stripe or bank transfer. Unless we agree otherwise in writing, payment must clear before production or dispatch.
5. Production, delivery and collection
Production and delivery dates are estimates unless we expressly agree a date in writing. Any delivery charge, method and expected timescale will be shown at checkout or confirmed with your quotation. We will deliver within the period agreed with you, or otherwise within 30 days, unless a different period is agreed.
Risk in goods passes to you when they are delivered to the address supplied, or when collected. Please inspect deliveries promptly and notify us of visible transit damage as soon as reasonably possible, without affecting any statutory rights.
6. Cancellations, returns and personalised goods
Consumers normally have a 14-day right to cancel many distance purchases. That right does not generally apply to goods made to a consumer's specifications or clearly personalised. This includes most embroidered, printed or otherwise customised garments and products. Your statutory rights for goods that are faulty, not as described or not fit for purpose are not affected.
For cancellation, return and fault queries, contact sales@designstitch.co.uk before sending goods back. Our Returns Policy explains the return-authorisation process and our voluntary returns arrangements for eligible plain, unworn goods.
7. Faults and our responsibility
Nothing in these terms limits rights that cannot lawfully be excluded. If you are a consumer, we remain responsible for supplying goods that conform with your statutory consumer rights. Where we are liable to a business customer, we do not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.
Subject to the preceding paragraph, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of goodwill. Our total liability to a business customer arising from an order is limited to the amount paid for that order.
8. Intellectual property and website use
All website content, branding and designs owned by us or our licensors remain protected by intellectual-property rights. You may use the website for lawful personal or business purchasing purposes. You must not misuse the website, interfere with its operation, scrape it, introduce harmful code, or use it in a way that infringes another person's rights.
9. Privacy
We process personal information as explained in our Privacy Notice. Payment-card information is processed by Stripe; we do not store full card details.
10. Changes and governing law
We may update these terms for future orders by publishing a revised version on this website. Each order is governed by the terms displayed when that order is accepted. These terms are governed by the law of England and Wales. Courts of England and Wales will have jurisdiction, except where mandatory consumer law provides otherwise.
